Florida's New Mandatory Condominium Inspection Laws: Drainage Safety
In light of the tragic collapse of the Champlain Towers South on June 24, 2021, the State of Florida Legislature enacted Senate Bill 4D in May 2022. This significant legislation requires rigorous inspections of condominium buildings of three stories or greater within three miles of the coast when they reach 25 years of age, and for those situated more than three miles from the coast when they reach 30 years. Moreover, buildings must undergo additional inspections every decade thereafter, with these inspection records made available to buyers, tenants, and unit owners. Notably, for buildings occupied before July 1, 1992, the first inspection must be carried out by December 31, 2024. The legislation bars condominium associations from waiving the collection of reserve funds intended for routine or necessary maintenance and repairs after this date.
Particular emphasis is now placed on ensuring that buildings, especially those in proximity to marine or coastal environments, are adequately inspected and maintained. Such properties are exposed to high wind weather events and corrosive salt environments, which can necessitate more frequent and comprehensive maintenance. The new laws underline the heightened concerns for these buildings, urging owners and managers to be vigilant in conducting regular inspections by licensed professionals and implementing robust maintenance programs.
